Access to files (Akteneinsicht)
The right of parties to an administrative procedure to inspect the authority's files, as far as they need this for their legal interests.
- Also called
- inspecting authority files, section 25 SGB X
The authority must allow parties to inspect the files, as far as knowing them is necessary to assert or defend their legal interests. If the files contain information about health circumstances, the authority can instead have the content communicated by a doctor. You can make copies yourself or have photocopies provided; the authority can demand reimbursement of its expenses to a reasonable extent. [1] Access to files is particularly useful if you want to understand a decision notice or give reasons for an objection. More: Applying and filing an objection.
Legal status: 08.10.2026. This is not legal advice; in an individual case, advice centres or specialist lawyers for social law can help.
