Hearing before a decision notice
Before an authority issues a decision notice that interferes with rights, it must give parties the opportunity to comment on the relevant facts.
- Also called
- hearing, section 24 SGB X
Before an administrative act is issued that interferes with the rights of a party, that party must be given the opportunity to comment on the facts relevant to the decision. This may be dispensed with only in the cases named in the law, for example where there is danger in delay. [1] If, for example, an existing benefit is to be reduced or withdrawn, you can therefore comment beforehand. If you receive a hearing notice, observe the deadline set and, if in doubt, get advice. The objection helps against the later notice. More: Applying and filing an objection.
Legal status: 08.10.2026. This is not legal advice; in an individual case, advice centres or specialist lawyers for social law can help.
